TERMS AND CONDITIONS

 

  1. This campaign titled as ‘EsselWorld Show your spirit’ is organized by EsselWorld and is subject to the following T&Cs. Participation in the Campaign shall be deemed as the acceptance of the T&C by the Participant.
  2. Any individual of any age group can participate in this campaign
  3. Registration for this campaign will start from 30th July 2020. Last date for registration & submission is 13th August 2020
  4. To participate in this campaign, participant needs to register themselves on the given link. On successful registration, upload a ‘home coming video’ of your loved one/ family member who was a patient of Covid- 19 on your instagram or facebook with #showyourspirit and tag EsselWorld as well. EsselWorld will feature the videos of the participants on its social media pages- Instagram and Facebook on 15 th August paying them a tribute
  5. EsselWorld reserves the rights but not an obligation, to pre-screen the uploaded video and reject the same which do not meet its criteria or are otherwise not acceptable or are objectionable or obscene or against these terms and conditions or are not in conformity with applicable laws, in its sole discretion.
  6. In the event of any violation of the T&Cs, EsselWorld Leisure Pvt Ltd. may in its sole discretion disqualify the entry from the campaign with immediate effect. By participating in the campaign, the participant also represents and warrants that he/she shall solely be liable for any and all action (criminal/civil) arising there from, whether in India or internationally, and shall also be liable to indemnify Licensed Entities (as defined), and any of its licensees etc. for any loss, claim, dispute, disruption caused to the Licensed Entities.
  7. EsselWorld Leisure Pvt Ltd shall not in any manner be responsible and/or liable for sharing, editing, morphing, digital alteration, manipulation, identity theft and/or unethical exploitation of a participant’s content(s).
  8. All incidental costs, applicable taxes or levies related to the gratification/prize, if any, shall be exclusively borne by the participant.
  9. The decision of EsselWorld Leisure Pvt. Ltd. in connection with the campaign shall be final, binding and will be non-contestable.
  10. The participant represents and warrants the following:
    1. Any information, content submitted by participant shall be true, correct and in compliance with all applicable laws.
    2. The content shall be suitable for presentation in a public forum.
    3. The content shall be original work created by the participant and that it shall in no manner infringe any rights including intellectual property rights, including without limitation, the copyright of a third person/party.
    4. The content shall not contain information known by the participant to be false, inaccurate or misleading, of any nature.
    5. The content should not be obscene, vulgar, defaming, denigrating women, artist, celebrity or children, hurting religious sentiments, depicting violence or against the public policy of India.
    6. The content shall not impersonate, infringes any third party's copyright, patent, trademark, trade secret, right of publicity, right of privacy, moral rights, and/or any other applicable personal or proprietary rights.
    7. The content shall not promote or advertise any product(s), service(s) or brand(s).
    8. The content shall not contain any material that is, or may reasonably be considered to be, hate speech, whether directed at an individual or group, and whether based upon the race, sex, creed, national origin, religious affiliation, marital status, sexual orientation, gender identity, or language of such individual or group or that is otherwise unlawfully threatening or unlawfully harassing to any individual, partnership, corporation, or political body.
    9. The content shall not contain material for which a participant was compensated or granted any consideration by any other third party.
    10. The content shall not disparage any person or party.
    11. The content shall not contain content that depicts alcohol, tobacco or narcotics.
    12. The content shall not in any manner depict or encourage harm or injury to any person, party, animal.
    13. The content shall not contain text, images, videos or artwork not created by the participant.
    14. Participant understands that once the content has been submitted in terms of this Campaign, all rights (including intellectual property rights) in and to the content shall be deemed to have been licensed irrevocably and non-exclusively, in perpetuity, and throughout the entire world, in favour of EsselWorld Leisure Pvt. Ltd for any kind of usage including without limitation the commercial exploitation through any medium.
    15. The content is/are not created by using any of the automated computer system. Normal Internet access and usage charges imposed by online service shall apply and has to be borne by the Participant.
    16. No license fee, royalties, charges, etc. are payable to any person/party/copyright society anywhere in the entire world, in relation to the content and the content are rights clear.
